1. Introduction
These Terms of Use govern access to and use of the website, online store, content, communication channels, products, and services operated by Sporadic Adaptoceuticals.
In these Terms:
“Sporadic,” “we,” “us,” and “our” refer to Sporadic Adaptoceuticals;
“Website” refers to www.sporadic.co.za and any related online store or web page operated by Sporadic;
“User,” “you,” and “your” refer to any person who accesses the Website, communicates with Sporadic, or purchases or uses our products or services;
“Customer” refers to a person who places or attempts to place an order with Sporadic;

2. Acceptance of These Terms
By accessing or using the Website, placing an order, creating an account, submitting an enquiry, or communicating with Sporadic for commercial purposes, you acknowledge that you have read, understood, and agreed to these Terms.

Sporadic may amend these Terms from time to time to reflect changes in:
Applicable law;

Our product range;
Payment methods;
Delivery procedures;
Business operations;
Technology;
Safety requirements; or
Customer-service practices.
The amended Terms will be published on the Website with an updated revision date.
The Terms applicable to an order will generally be those in effect when the order is placed, unless:
A later amendment is required by law;
The change benefits the customer;
The parties agree otherwise; or
The amendment concerns future use of the Website rather than an existing order.
Continued use of the Website after amended Terms are published constitutes acknowledgement of the revised Terms, subject to applicable law.
5. Eligibility to Use the Website

Customers are responsible for securely storing all products away from children and unauthorised persons.
8. Lawful Use

You must not use Sporadic’s Website, products, services, or communication channels to:
Commit or promote an unlawful act;
Obtain products unlawfully;
Supply age-restricted products to minors;
Misrepresent your identity or age;
Mislead Sporadic about the intended destination or recipient;
Evade applicable legal restrictions;
Resell a product unlawfully;
Alter a product for unlawful distribution;
Promote unsafe or reckless use;
Make fraudulent claims;
Interfere with an investigation;
Infringe another person’s rights; or
Encourage conduct that creates an unreasonable safety risk.
The availability of a product on the Website does not represent that the product may lawfully be purchased, possessed, transported, supplied, or used in every jurisdiction.
Customers are responsible for understanding and complying with the laws applicable to their location and circumstances.

Sporadic makes reasonable efforts to ensure that Website information is clear and accurate.
However, Website content may occasionally contain:

11. No Guaranteed Outcome
Sporadic does not guarantee that a product, routine, piece of content, or recommendation will produce a particular result.
Individual experiences may differ because of factors including:
Age;
Body composition;
Health;
Medication;
Allergies;
Sensitivities;
Lifestyle;
Sleep;
Diet;
Frequency of use;
Quantity used;
Product storage;
Personal expectations; and
Other individual circumstances.
A product is not automatically defective merely because a customer:
Does not experience an expected result;
Experiences a different result from another customer;
Dislikes its taste, smell, texture, or appearance;
Changes their mind;
Uses it incorrectly; or
Relies on a testimonial as a guarantee.
This does not limit any legal remedy where a product was defective, unsafe, materially misrepresented, contaminated, or incorrectly supplied.
12. Product Descriptions
We aim to describe products accurately and in plain language.
Descriptions may include:
Product name;
Intended use;
Ingredients;
Quantity;
Suggested serving;
Strength or concentration;
Packaging;
Storage instructions;
Warnings;
Availability; and
General wellness positioning.
Minor differences in natural products may occur between batches, including differences in:
Colour;
Aroma;
Texture;
Density;
Shape;
Appearance; or
Natural ingredient characteristics.
A minor natural variation that does not materially affect the product’s safety, quantity, quality, or intended use will not automatically constitute a defect.
13. Product Images
Product images are provided for identification, presentation, or marketing purposes.
Actual products may differ slightly from images in relation to:
Colour;
Label placement;
Packaging style;
Container shape;
Capsule colour;
Product texture;
Batch appearance;
Scale; or
Supporting decorative elements.
Screen settings, lighting, photography, and design mock-ups may also affect appearance.
Where a visual difference materially changes what the customer ordered, the customer may contact Sporadic under our Refund, Return and Exchange Policy.
14. Product Availability
All products are subject to availability.
Adding a product to a shopping cart, submitting an enquiry, or receiving an automated message does not guarantee stock availability.
Sporadic may:
Limit quantities;
Withdraw a product;
Place a product on back order;
Stop accepting orders;
Restrict delivery to certain areas;
Change a formulation or package;
Suspend sales for safety or compliance reasons; or
Cancel an unavailable item.
Where a paid product becomes unavailable, we will contact the customer and provide an appropriate remedy, which may include:
A refund;
A replacement product with the customer’s agreement;
Store credit with the customer’s agreement; or
Delayed fulfilment with the customer’s agreement.
15. Prices
Prices are displayed in South African rand unless clearly stated otherwise.
Prices may change without prior notice, but a price change will not ordinarily affect an order already accepted and paid for.
Displayed prices may exclude delivery charges unless the Website clearly states that delivery is included.
The total payable amount may include:
Product price;
Delivery charge;
Additional agreed services;
Payment-provider charges where lawfully disclosed; and
Any applicable tax.
Customers should review the full order total before paying.
16. Pricing Errors
Sporadic may correct an obvious pricing, calculation, or description error.
If a product was displayed at an obviously incorrect price, we may contact the customer before fulfilment and offer the customer the opportunity to:
Confirm the order at the correct price; or
Cancel the affected product or order for a refund.
We will not use this clause to avoid a genuine advertised price or promotion merely because Sporadic later regrets offering it.
Any correction will be handled fairly and in accordance with applicable law.
17. Promotions and Discounts
Promotions may be subject to additional terms, including:
Start and end dates;
Limited quantities;
Product exclusions;
Customer eligibility;
One use per customer;
Minimum order values;
Specific delivery areas;
Unique promotional codes; or
Other reasonable restrictions.
Unless otherwise stated:
Promotions cannot be exchanged for cash;
Promotional codes cannot be combined;
Discounts apply only during the stated period;
Free gifts are available while stocks last; and
A promotion cannot be applied retrospectively to a completed order.
Where promotional terms conflict with mandatory consumer law, the applicable law will take precedence.
18. Orders as Offers to Purchase
Submitting an order generally constitutes an offer by the customer to purchase the selected products.
An automated order acknowledgement confirms that the order was received. It does not necessarily mean that the order has been accepted.
An order may be accepted when Sporadic:
Confirms acceptance;
Confirms payment and begins fulfilment;
Dispatches the order; or
Otherwise clearly communicates acceptance.
Sporadic may refuse or cancel an order before acceptance for a lawful and reasonable reason.
19. Reasons an Order May Be Refused or Cancelled
An order may be refused, suspended, limited, or cancelled where:
A product is unavailable;
The price or description was materially incorrect;
Payment is not received;
Payment cannot be verified;
Fraud is reasonably suspected;
The customer provides false information;
The delivery address is incomplete or invalid;
The order appears intended for unlawful use;
The customer does not meet an age requirement;
The order exceeds quantity limits;
Fulfilment would create an unreasonable safety risk;
Delivery is unavailable to the destination;
The customer has abused previous transactions;
Processing the order would breach applicable law; or
Circumstances beyond our reasonable control prevent fulfilment.
Where payment has already been received and Sporadic lawfully cancels the order, the amount due will be refunded in accordance with applicable law and our Refund Policy.
20. Orders Placed Through WhatsApp or Social Media
Orders may be arranged through WhatsApp, direct message, telephone, or another approved communication channel.
A social-media comment does not by itself constitute a confirmed order.
An order placed through an informal channel becomes subject to these Terms once the customer:
Confirms the products requested;
Receives or accepts the price;
Provides the required delivery information;
Makes payment or agrees to the payment arrangement; or
Otherwise clearly instructs Sporadic to proceed.
Customers must review order details carefully before confirming payment.
21. Customer Information
Customers must provide accurate and complete information, including:
Name;
Contact number;
Email address where required;
Delivery address;
Product selection;
Quantity;
Payment reference; and
Any reasonably necessary delivery instructions.
Sporadic is not responsible for loss or delay resulting from materially inaccurate information supplied by the customer, except to the extent that Sporadic caused or contributed to the problem.
Customers must notify us promptly if information changes before dispatch.
22. Payment
Orders must be paid through a payment method accepted by Sporadic.
Accepted payment methods may change and may include:
Electronic funds transfer;
Payment gateway;
Card payment;
Cash where specifically agreed; or
Another approved method.
An order is not considered paid until the payment has cleared or been reliably confirmed.
A screenshot or proof-of-payment image does not necessarily prove that funds have cleared.
Sporadic may verify a payment before dispatching an order.
23. Payment Security
Customers must not send Sporadic:
Banking passwords;
Bank card PINs;
One-time passwords;
Full card-security codes; or
Other confidential banking credentials.
Sporadic will not be responsible for a customer voluntarily disclosing banking credentials to an unauthorised person falsely claiming to represent Sporadic, unless Sporadic’s own conduct caused or materially contributed to the loss.
Customers should verify payment instructions before transferring money.
Any suspected impersonation or payment fraud should be reported immediately.
24. Fraud Prevention
Sporadic may take reasonable steps to verify:
Customer identity;
Age;
Payment;
Delivery address;
Order legitimacy;
Refund banking details; and
Authority to use a payment method.
We may delay fulfilment while carrying out a reasonable fraud or security check.
Orders linked to suspected fraud, stolen payment information, false identities, manipulated payment confirmations, or chargeback abuse may be cancelled and reported to relevant service providers or authorities.
25. Delivery
Delivery is subject to:
Product availability;
Payment confirmation;
Customer location;
Courier availability;
Correct delivery information;
Safety considerations; and
Circumstances beyond Sporadic’s reasonable control.
Any delivery date or timeframe is an estimate unless expressly agreed as a guaranteed date.
Sporadic will make reasonable efforts to fulfil an order within the communicated period.
The customer must ensure that:
The address is correct;
The location is accessible;
A responsible person is available to receive the parcel;
The contact number is active; and
Any access instructions are supplied in advance.
26. Delivery to Another Person
A customer may request delivery to another adult where legally permitted.
By doing so, the customer confirms that:
They have permission to provide the recipient’s information;
The recipient may lawfully receive the product;
The recipient meets any age requirement;
The address is accurate; and
The recipient has agreed to receive the delivery.
Sporadic may refuse to deliver an age-restricted product where the recipient’s eligibility cannot reasonably be verified.
27. Risk and Responsibility After Delivery
Responsibility for storing and securing the product passes to the customer or authorised recipient after lawful delivery, subject to applicable consumer law.
After delivery, the customer is responsible for:
Reading the label;
Inspecting the seal;
Following storage instructions;
Keeping the product away from children;
Preventing unauthorised access;
Avoiding contamination;
Using the product responsibly; and
Reporting visible damage or tampering promptly.
This clause does not remove Sporadic’s responsibility for a defect, contamination, damage, or safety issue that existed when the product was supplied.
28. Inspection on Delivery
Customers should inspect the parcel and products as soon as reasonably possible.
The customer should check:
The product name;
Quantity;
Seal;
Container;
Packaging;
Visible leakage;
Physical damage;
Batch information; and
Whether the order is complete.
A visibly damaged, leaking, open, or tampered-with product should not be consumed.
Customers should retain all packaging and contact Sporadic promptly with photographs or videos where appropriate.
29. Returns, Refunds and Exchanges
Returns, refunds, and exchanges are governed by Sporadic’s Refund, Return and Exchange Policy and applicable law.
For health, hygiene, safety, and contamination-control reasons, an opened consumable product will generally not qualify for a change-of-mind return.
A broken, lifted, punctured, removed, altered, or damaged tamper-evident seal will generally be treated as evidence that the bottle or container may have been opened.
Once opened, Sporadic cannot verify whether the product:
Was used;
Was altered;
Was contaminated;
Was exposed to unsuitable conditions;
Had contents removed;
Had another substance added; or
Remains safe for resale.
This restriction does not remove a customer’s rights where the product:
Arrived unsealed;
Arrived damaged;
Was defective;
Was unsafe;
Was contaminated before delivery;
Was materially misrepresented;
Was incorrectly supplied; or
Otherwise failed to comply with applicable law.
30. Product Storage
Customers must follow all storage instructions appearing on:
The product label;
Packaging;
Website;
Product information; or
Written instructions supplied by Sporadic.
Unless otherwise indicated, products should generally be:
Kept securely closed;
Kept away from children and animals;
Protected from excessive heat;
Protected from direct sunlight;
Protected from moisture;
Stored in their original container; and
Kept away from contamination.
Sporadic is not responsible for deterioration caused after delivery by improper storage, mishandling, transfer to another container, or exposure to unsuitable conditions.
31. Product Use
Customers must:
Read the complete product label;
Follow usage instructions;
Observe warnings;
Avoid exceeding stated or recommended amounts;
Check the ingredient list;
Consider allergies and sensitivities;
Seek professional advice where appropriate;
Avoid combining products irresponsibly; and
Stop using a product where continued use presents a reasonable safety concern.
Products must not be used for a purpose for which they were not intended.
32. Impairment and Safety
A customer must not drive, operate machinery, work at height, supervise dangerous equipment, perform hazardous work, or engage in another activity requiring unimpaired judgment where a product may cause impairment, drowsiness, altered perception, delayed reactions, or reduced coordination.
Customers must use appropriate judgment before undertaking:
Driving;
Childcare;
Workplace duties;
Financial decisions;
Legal decisions;
Swimming;
Cooking with dangerous equipment;
Handling weapons;
Operating tools; or
Any other safety-sensitive activity.
Sporadic does not encourage unsafe, reckless, or unlawful product use.
33. Resale and Redistribution
Products are generally sold for personal use unless Sporadic agrees otherwise in writing.
Customers must not:
Present themselves as an authorised Sporadic agent without permission;
Alter Sporadic labels;
Remove batch or safety information;
Repackage products under the Sporadic name;
Refill Sporadic containers;
Sell counterfeit products;
Dilute or modify a product and continue representing it as original;
Make unauthorised medical claims about Sporadic products;
Use Sporadic branding on unrelated goods; or
Resell products unlawfully.
Authorised stockists, agents, or resellers may be subject to separate written terms.
34. Customer Accounts
Where the Website allows customer accounts, users are responsible for:
Maintaining accurate account information;
Protecting passwords;
Restricting access to their device;
Logging out of shared devices;
Monitoring account activity; and
Reporting unauthorised use.
Customers must not:
Create an account using another person’s identity;
Share an account for unlawful purchasing;
Use automated systems to create accounts;
Circumvent purchasing restrictions; or
Access another customer’s account.
Sporadic may suspend an account where there are reasonable grounds to suspect fraud, unlawful use, or a security compromise.
35. Acceptable Website Use
You may browse and use the Website for personal, lawful, and non-commercial purposes, including:
Viewing products;
Reading educational content;
Placing lawful orders;
Contacting Sporadic;
Sharing unaltered public content through authorised sharing tools; and
Managing your own account.
Any use outside these purposes requires prior written permission where it involves Sporadic’s intellectual property, systems, data, or commercial interests.
36. Prohibited Website Conduct
You must not:
Hack or attempt to hack the Website;
Introduce malware, ransomware, spyware, viruses, or harmful code;
Interfere with Website operation;
Bypass security controls;
Attempt to access restricted systems;
Scrape Website content at scale;
Use bots to place orders or manipulate promotions;

Impersonate Sporadic;
Submit false reviews;
Harass customers or representatives;
Use the Website for spam;
Upload unlawful or infringing material;
Manipulate prices or transactions;
Conduct denial-of-service attacks; or
Use Website information to facilitate fraud or unlawful activity.
Suspected criminal conduct may be reported to relevant authorities.
37. User Submissions
Users may submit:

Testimonials;
Comments;
Questions;
Photographs;
Videos;
Suggestions;
Product feedback; or
Other content.
By submitting material, the user confirms that:
They created it or have permission to submit it;
It does not infringe another person’s rights;
It is not knowingly false;
It is not unlawful;
It does not contain malicious code;
It does not disclose another person’s private information without authority; and
Its submission does not breach another agreement.
Submitting private material does not automatically grant Sporadic permission to publish it publicly.
38. Reviews and Testimonials
Customer reviews and testimonials reflect individual experiences.
Sporadic may moderate or decline to publish content that:
Contains personal information;
Is abusive or threatening;
Contains unlawful claims;
Promotes unsafe conduct;
Is unrelated to the product;
Contains spam;
Infringes intellectual property;
Is demonstrably fraudulent; or
Violates platform rules.
Sporadic will not remove a genuine negative review merely because it is unfavourable, although we may contact the customer to investigate the concern.
Private customer messages will not be used as public testimonials without appropriate permission.
39. Licence for Approved Public Submissions
Where a customer expressly permits Sporadic to publish a review, image, testimonial, or other submission, the customer grants Sporadic a non-exclusive licence to reproduce, display, format, and share that material for the agreed purpose.
Sporadic will respect any agreed limitations concerning:
Anonymity;
Use of a first name only;
Social-media identification;
Image use;
Editing; or
Publication channels.
Sporadic may correct spelling or format content for presentation, but will not intentionally change the meaning of a testimonial.
40. Intellectual Property
Unless otherwise stated, all original Sporadic Content is owned by, licensed to, or lawfully used by Sporadic.
This may include:
The Sporadic name;
Logos;
Product names;
Labels;
Product artwork;
Packaging designs;
Website text;
Educational material;
Photographs;
Videos;
Illustrations;
Advertising designs;
Characters;
Slogans;
Graphics;
Downloadable materials; and
Social-media content.
Nothing in these Terms transfers ownership of Sporadic’s intellectual property to a user.
41. Permitted Sharing
Users may share Sporadic’s public content through built-in social-media sharing tools, provided that:
The content is not misleadingly altered;
Sporadic remains identified as the source;
The content is not used to promote an unrelated product;
The content is not presented as the user’s own creation;
The content is not used unlawfully; and
Any copyright or branding notice remains intact.
Permission to share public content does not include permission to manufacture, imitate, repackage, or sell Sporadic products.
42. Prohibited Use of Sporadic Content
Without prior written permission, users must not:
Reproduce substantial Website content commercially;
Copy labels or packaging;
Remove Sporadic branding;
Create counterfeit products;
Sell Sporadic artwork;
Use Sporadic content in paid advertising;
Register confusingly similar names or accounts;
Pretend to be an authorised representative;
Use Sporadic customer testimonials for another brand;
Train commercial systems on proprietary Sporadic materials where permission is legally required; or
Modify Sporadic content in a way that damages the brand or misleads customers.
43. Third-Party Intellectual Property
Any third-party trade marks, platforms, research references, photographs, names, or content remain the property of their respective owners.
Reference to a third party does not necessarily imply:
Sponsorship;
Endorsement;
Partnership;
Approval; or
Affiliation.
Users must comply with third-party rights and platform terms.

Social-media platforms;
Retailers;

Sporadic does not control independent third-party websites and does not guarantee their:

Products;
Services; or
Content.
Users access third-party websites at their own discretion and should review the third party’s terms and privacy policy.
45. Social-Media Platforms
Sporadic uses third-party platforms such as WhatsApp, Instagram, Facebook, and Threads.
Use of those platforms is also subject to the terms and policies of the platform operator.
Sporadic does not control:
Platform availability;
Account suspension;
Algorithmic distribution;
Advertising systems;
Platform data collection;
Message encryption;
Public comments;
Screenshots;
Forwarding by other users; or
Changes to platform functions.
Private matters should be communicated directly rather than posted publicly.
46. Website Availability
Sporadic aims to keep the Website functional and accessible but does not guarantee uninterrupted availability.
The Website may be unavailable because of:
Maintenance;
Updates;
Hosting problems;
Power failures;
Load shedding;
Cybersecurity incidents;
Internet interruptions;
Third-party service failures;
Technical defects;

Sporadic does not sell customer personal information.

50. Emergencies
Sporadic’s Website, WhatsApp, social-media pages, and customer-service channels are not emergency services.
A person experiencing a medical emergency, severe adverse reaction, loss of consciousness, breathing difficulty, serious psychological distress, or immediate danger should seek urgent professional assistance through appropriate local emergency services.
Messages sent to Sporadic may not be reviewed immediately and must not be relied upon during an emergency.
51. Limitation of Liability
To the fullest extent permitted by law, Sporadic will not be liable for indirect, incidental, special, or consequential loss arising from:
Unlawful use of the Website;
Improper product use;
Exceeding stated usage instructions;
Ignoring product warnings;
Combining products irresponsibly;
Failure to disclose relevant information to a healthcare professional;
Improper storage after delivery;
Product tampering after delivery;
Unauthorised access caused by the customer;
Reliance on general educational content as professional advice;
Third-party websites or services;
Events beyond Sporadic’s reasonable control; or
Conduct by an independent third party.
This clause does not exclude or limit liability where doing so would be unlawful.
In particular, nothing in these Terms excludes liability for:
Gross negligence where liability cannot lawfully be excluded;
Fraud;
Intentional unlawful conduct;
Defective or unsafe products where statutory liability applies;
Breach of mandatory consumer rights; or
Any other liability that cannot lawfully be limited.
52. Customer Responsibility
Customers are responsible for losses or consequences caused by their own:
Fraud;
Intentional misuse;
Unlawful conduct;
Product tampering;
False information;
Unauthorised resale;
Improper storage;
Failure to follow instructions;
Breach of another person’s rights; or
Material breach of these Terms.
Sporadic will not use this clause to transfer responsibility for loss caused by Sporadic’s own unlawful conduct, defect, breach, or negligence where responsibility cannot lawfully be excluded.
53. Indemnity for Unlawful Conduct
To the extent permitted by law, a user may be responsible for reasonable loss, liability, or expense incurred by Sporadic because of the user’s:
Fraud;
Counterfeiting;
Unauthorised commercial use of Sporadic intellectual property;
Deliberate cyberattack;
False representation of being associated with Sporadic;
Unlawful resale;
Malicious publication;
Infringement of third-party rights; or
Other intentional unlawful conduct.
This provision does not require a consumer to indemnify Sporadic for Sporadic’s own gross negligence, unlawful conduct, or statutory responsibility.
54. Suspension or Termination of Access
Sporadic may suspend, limit, or terminate a user’s access to the Website or services where there are reasonable grounds to believe the user has:
Breached these Terms;
Committed fraud;
Threatened another person;
Abused staff or customers;
Attacked the Website;
Misused customer data;
Infringed intellectual property;
Used the Website unlawfully;
Repeatedly abused promotional offers;
Attempted to supply products unlawfully; or
Created a material safety or security risk.
Where appropriate, Sporadic may provide notice and an opportunity to address the concern.
Immediate action may be taken where necessary to prevent harm, fraud, unlawful conduct, or a security incident.
55. Complaints and Customer Support
Customers should contact Sporadic promptly regarding:
Incorrect products;
Damaged deliveries;
Missing items;
Payment concerns;
Privacy concerns;
Website errors;
Suspected fraud;
Product-quality issues; or
Other complaints.
A complaint should include:
Customer name;
Order reference;
Date of purchase;
Description of the issue;
Supporting photographs where relevant; and
The resolution requested.
Sporadic will make reasonable efforts to investigate and respond fairly.
56. Dispute Resolution
The parties should first attempt to resolve a dispute directly and in good faith.

Nothing in these Terms prevents a customer from approaching:
The National Consumer Commission;
A relevant consumer goods and services ombud;

A court;

An alternative dispute-resolution body; or
Another authority with lawful jurisdiction.
No internal complaint procedure removes a customer’s statutory rights.
57. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any dispute concerning these Terms, the Website, or a transaction with Sporadic will be subject to the jurisdiction of a court, tribunal, ombud, regulator, or consumer body legally entitled to hear the matter.
Nothing in this section unlawfully prevents a consumer from bringing proceedings in a forum available to them under applicable law.
58. Electronic Communications
Users agree that communications relating to the Website or a transaction may take place electronically, including through:

Electronic invoices;

Urgent medical matters must not be sent through ordinary customer-service channels.
61. Force Majeure and Events Beyond Reasonable Control
Sporadic will not be responsible for a delay or failure caused by an event beyond its reasonable control, including:
Natural disaster;
Severe weather;
Fire;
Flood;
Epidemic;
Pandemic;
Civil unrest;
Strike;
Road closure;
Courier disruption;
Power failure;
Load shedding;
Telecommunications failure;
Cyberattack;
Government restriction;
Import or supply interruption; or
Failure of a critical third-party service.
Sporadic will make reasonable efforts to minimise disruption and communicate with affected customers.
This clause does not permit Sporadic to retain payment indefinitely where an order cannot lawfully be fulfilled.
62. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable:
That provision will be limited or removed only to the extent necessary;
The remaining provisions will continue to apply; and
The Terms will be interpreted as closely as possible to their lawful purpose.
63. No Waiver
A failure or delay by Sporadic in enforcing a provision does not automatically mean that Sporadic has permanently waived that provision.
A waiver will apply only to the specific circumstance for which it was given.
Nothing in this clause prevents a consumer from relying on a lawful representation, agreement, or right.
64. Entire Agreement
These Terms, together with the policies and information expressly incorporated into them, form the agreement governing use of the Website and orders placed with Sporadic.
They include, where applicable:

Order confirmations;
Refund Policy;
Privacy Policy;
Company Disclaimer;
Medical Disclaimer;
Product labels;
Promotional terms; and

Where a representative of Sporadic makes a clear written commitment concerning a specific order, that commitment may form part of the transaction.
65. Order of Interpretation
Where documents appear inconsistent, they should be interpreted together and in a manner that best protects mandatory consumer rights.

66. Assignment and Transfer
A customer may not transfer an account, order, or contractual right to another person where doing so would:

A joint venture;
An agency relationship;
A franchise;

A person may represent Sporadic only where Sporadic has expressly authorised them to do so.
